Is Kratom Legal in My State?
Kratom is legal in most US states, but laws vary — and a handful of states or cities have specific restrictions that change every year. Here's the quick reference, fully updated for 2026, with citations.
The short version
Kratom (Mitragyna speciosa) is federally legal in the United States. It is not a controlled substance at the federal level. The DEA briefly tried to schedule it in 2016 and backed down after public pushback. The FDA has issued advisories but no ban. The actual restrictions happen at the state, city, and county level — and that's where the map gets complicated.

Federal status
Legal at the federal level
Kratom is not scheduled by the Drug Enforcement Administration (DEA) and is not classified as a controlled substance under the federal Controlled Substances Act. The DEA's 2016 attempt to emergency-schedule mitragynine and 7-hydroxymitragynine was withdrawn following public comment and congressional pushback. The FDA has issued advisories and import alerts but no federal ban.

States with full kratom bans
These states classify kratom (or its primary alkaloids mitragynine and 7-hydroxymitragynine) as controlled substances. We do not ship kratom products to these addresses — our checkout blocks them automatically.
States with Kratom Consumer Protection Act (KCPA)
The Kratom Consumer Protection Act is model legislation pushed by the American Kratom Association that keeps kratom legal while adding consumer protections: minimum age requirements (usually 21+), labeling standards, alkaloid concentration limits, and bans on adulterated or synthetic 7-OH products. States with the KCPA on the books tend to have the most stable, predictable kratom market.
City & county-level bans
Even in states where kratom is legal, specific cities and counties have passed local bans. Our checkout blocks shipping to these addresses automatically.
- Denver, Colorado — bans the sale and distribution of kratom within city limits. The state of Colorado as a whole is KCPA-protected, but the Denver ordinance overrides for local addresses.
- Monument, Parker, and Greenwood Village, Colorado — additional Colorado municipalities with kratom restrictions.
- Sarasota County, Florida — long-standing county-level ban. Florida is otherwise KCPA-protected.
- Jerseyville, Alton, and Edwardsville, Illinois — three Illinois cities have ordinances banning sale or possession of kratom products.
- Certain counties in Mississippi — multiple Mississippi counties have full kratom bans on top of the state's restrictions on synthetic extracts and high-concentration 7-OH products.
- Ontario, Oregon — local kratom ordinance restricting sale.
Extract & 7-OH-specific rules
Extracts and 7-hydroxymitragynine (7-OH) products face a separate layer of state-level restrictions on top of any raw-leaf rules. Some states allow kratom leaf but ban concentrated extracts or synthetic/high-concentration 7-OH formulations.
- California — as of 2026, banned the sale and manufacture of all kratom and 7-OH products statewide. We do not ship kratom of any kind to California.
- Mississippi — bans synthetic kratom extracts and high-concentration 7-OH products statewide; some counties have full kratom bans on top of that.
- Connecticut, Kansas, Louisiana, Michigan — classify kratom and its derivatives (including 7-OH) as controlled substances, so extracts and 7-OH are blocked along with raw leaf.

Tennessee — kratom ban pending governor's signature
The Tennessee legislature passed a statewide kratom prohibition bill. If signed by the governor, Tennessee becomes the next state to ban kratom outright. Track for updates.
California — full kratom & 7-OH ban statewide
California passed legislation banning the sale and manufacture of kratom and 7-OH products throughout the state. We stopped shipping to California addresses immediately when this took effect.
Rhode Island — statewide kratom ban LIFTED
Rhode Island had banned kratom for years. The state lifted the ban effective April 1, 2026. Rhode Island residents can now legally purchase kratom again, and we can ship there.
Multiple states adopted KCPA protections
Texas, Florida, New Jersey, New York, Maine, Maryland, and others passed or strengthened Kratom Consumer Protection Acts. These laws keep kratom legal but require age gating, labeling standards, and quality testing — which makes them favorable for legitimate operators like us.

What is 7-OH and why are some states regulating it separately from kratom?
7-hydroxymitragynine (7-OH) is one of the active alkaloids naturally present in kratom leaf at trace levels. Some manufacturers concentrate or synthesize 7-OH into high-dose products that behave very differently from natural full-spectrum kratom extract. Several states have responded by passing laws that allow natural kratom but restrict isolated or synthetic 7-OH products. AK-280 is a full-spectrum natural extract, not a 7-OH isolate.
